my car finance company are repeatedly failing to take my firect debit and this happens for 2 or 3 months every 5 months or so. this has drastically affected my credit rating and they do not notify me of this happening until 4 months has gone unpaid. the payment comes from my bills account which i never check, simply put the right money into each month. what rights do i have? my credit file says i am a default payer and i have now been turned down for a mortgage because of it. what can i do and what is their responsibility level with this situation?

Seems like you are in a catch 22 situation!
Although this is under a direct debit agreement, it is you responsibility to make sure the payments actually leave your bank.
As for the finance company, they really should be telling you earlier if you payments fail. I don't think you have a leg to stand on, personally. They will just say it your fault, legally speaking it is your fault.
As for your credit file, you can retrieve this data from equifax or expierian, just google it. It costs about £2.
Take alook at this credit file, then contact the company and ask them, what are they going to do about it.
Altough it might be your fault but try and push them a little, they might be able to do something.
For the future, id suggest you keep a close eye on you outgoing finances
hope this helps

You admit YOU never check your own account. It is ALWAYS your responsibility to make sure payments are made. Your credit report says you are in default because YOU ARE IN DEFAULT. Your 'rights' are to PAY YOUR BILLS.
