i have a 15 months old boy his father is in and out of his life its been 5 months know he has not seen his son and hes takeing me back to court so he can have him on weekends but its been 11 months and out off 9 times in 11 months he seen his son and my son has Problems brething i took him to the dr and they told me he cant be around people who smokes and his father smokes and his girlfriend dose to can the judge still let him go and see his dad my son is on a thing so he can

Family first. But in the laws of the court your ex does have legal right to the child even if he does not come and see him. The one person he is hurting, he should be close to. Tell the ex he can't smoke around him because of the medical problems. if your child smells like smoke I would take him to court to make it supervised and not unsupervised. I bet you he will not come and get the baby every weekend. it is a control thing.

Try to organize your thoughts better for the judge than you have here. Bring a note from the doctor with you and specific dates when the father has been to see your son. If you're organized, speak clearly and don't go hysterical, the judge should rule for you.

Well get some proof that his father n his gf smokes n the judge'll make sure ur son doesn't go there at all, on terms of unacceptable health conditions.

Im afraid a judge can force you to let him see him. You need to tell the judge exactly how you feel and why you think its a bad idea. I would also suggest seeing about him getting supervised visitation so they can not smoke around your child.

Not if the conditions will harm your child get a doctors note that your baby can not be around smoke then mention that in court good lcuk =]

You need to have a doctor sign and agree that your son has this problem..and that you're not just making it up as an excuse.

You have to think of your son first. It is acceptable to place conditions on any visit.

Let him see his father but talk to him about it and tell him he better not smake any where near his son.
