Quit and get a different job, if people could sue for bad language think how rich telemarketers would be. If he did not actually kick your a**, then there was no damage. Get a different boss.

I'd guess Texas is a "right to work" state, which sort of means you don't have a right to work, or workers rights, unless there's a contract and it's blatantly violated.
If it gets sexually harrassing towards you, you'd have a case.
If you file a report for his cussin' and horsing around like that, you'll lose your job, lose your case, and lose money and time.
If he really seems threatening and it's obviously not a joke, you should file a police report.
Still, your case doesn't sound so bad from what you say, if there's lots more, keep a log with dates and times, and if he's harrassing (especially women, since guys usually don't take offense at raunchy jokes), you could get the girls involved too, if they are also offended.
Why don't you humor him? Tell him "Shoo boss, yo' breath!!! You've been eating a** again. He might promote you and give you a raise.

that is to me is verbal abuse. It penetrates mentally and next time you know, you'll be using the same words to others. He is not a good person to sorround your self with. You have to have a witness everytime he say that to you - not just one occassion but 2 or more. different people that hear it would be very beneficial. When you collected enough evidence, you have to confront him with the matter in front of these people who heard it - making yourself the pitiful one and really the victim. Maybe a lot of you have the same feelings but just keeping silent about it because of job security. You say I can't take this anymore. And let people know that it would be nicer environment if there is nothing like that happening around. Get 2 or 3 people together (not for the purpose that you are just asking about their experiences with the guy) but make it coincedencial. (Like "Oh, what a coincedence!") The reason is to create a support for your case if you want to go farther with this (Court). When you do this - make sure you are already interviewing for another company because lose or win you have to have a job. Right? Good Luck.

I say you could get him for some type of harrassment,If he says dirty jokes to you, you might be able to get him for sexual harrassment.
