my husband and i do not get along and the no fault law does not apply in NY yet. what do i do?

well, technincally no, new york doesn't have a no-fault divorce, what they have is legal separation...where the parties live apart under a court ordered separation for a period of one year, and as long as all provisions of the separation are adhered to, you get an uncontested "no-fault" divorce.

For any divorce in New York though, it is highly suggested you retain an attorney.

If your husband won't agree to a legal separation - then the grounds you have to file under is "cruel & inhuman treatment" . A contested divorce inNew York can take anywhere from one to three years to finalize.

file for uncontested divorce on the grounds of lack of sex (there's a more legal definition). divorce records are sealed, so no one will know why you got divorced--thats what my lawyer told me.
