Can the parent then re-locate du to the fact there is a 4 year restraining order?

When the other parent goes to jail, file a motion to modify the agreement and file for sole custody. Usually it will depend on the length of time, the crime etc.

The parent that is not incarcerated needs to petition the court for full custody of the child(ren). After that, relocation should be allowed with no problem!!
