could I take him to court? I learned in my (one and only) law class that a verbal contract is legal as long as goods are under $500, I am not sure if cash is considered goods, but it was less than $500 ($325). This happened in the state where I reside, but since then (and it has only been a month or so, but our agreement for payback was 2 weeks ago) he has moved. also, we agreed on that date when the other person had a job which fell through. he now has a different job though, so you cant say I wont get the money if he doesnt have a job.

Oh, and I have left him (nice!) messages about it and he wont return my calls. and I just got through to him and my signal failed, now his phone is off.

my fiance was with when I went to withdrawl the money from the bank. (and so was the person "borrowing" the money)

It would be a lot easier if you had something in writing. You can take him to small claims court, but you still may lose. Try to gather any other type of proof that you may have to help you prove your case. Did you tell anyone else that you had loaned him the money? Did he leave any messages on your voice mail regarding the loan? If there are any other people who knew about the loan, they can come to court with you and help you plead your case. In the future, I'd recommend not loaning anyone money.

in your case; you could bring that person to SMALL CLAIM COURT which handles claims and cases under 5000. it is up to the judge who decide which party is right. if that person does not show up for the court date; he or she will lose the case automatically. good luck to you to get the money back

Well if nothing is in writing then you can't legally prove it in a Court of Law.

consider it a lesson learned. there is no way you can proof you loaned the money.
