No, if his name is not on the registration, then you can get it anytime. Just call the police and have them go with you.

No, he cannot. However, depending on certain facts,t he Court -could- award it to your husband. But in the meantime, ESPECIALLY if it is your only vehicle, it's yours, girl. If necessary, take the police to go retrieve the item. Cops do not like to get involved with domestic stuff like this, but they will go with you unless they are totally incompetent.

If you know where it is, I would take the title with me when the police escort me to retrieve it. You should then get it on file with the police dept in case your husband tries to steal it back or it gets vandalized.

You are "seperated", not divorced.. therefore ALL property within the marriage is considered "Mutual" property.
IF your seperation is legal... bring the paperwork to the police dept.. show them you are Legally Seperated and have them run your tag number or vin number to prove that the vehicle is in YOUR name ONLY.
Then, request they escort you there to retrieve it.

well thats why you never gget any thing in both names cause im sure the payments and insurance are in both names also so if he defaulys it goes on yr credit also i know i am divorced and went thru thisthis will not be settled till court or he can write you up a ncie letter and you can sell him the truck or just cut your loses

Nope, he can not get it titled or licensed if it is in your name alone. So call the police and report it stolen.
