okaaaay I REALLY NEED HELP!!!

my love of my life--my soon to be husband is a cuban citizen with permission and a work visa to be in Mexico. Unfortunately his visa term is coming to an end, and he wants to marry me (we're expecting), we've been together for quite sometime, he wants to return to cuba to see his 84 y/o grandmother 1 last time before he enters the US----IF I FILE a I-129F form a fiance visa form---how will he get out of Cuba...will he even be able to leave? I know Cuba does not allow air travel to the United States---would they allow him to enter mexico??? please help---USCIS cannot answer this question---and the State department Visa section always has me on hold for more than 30 minutes and then bounces me back to the main menu and then hangs up...please help---he wants to leave next wed. or thurs!!!!!!!!!!

He needs to stay in Mexico, or another country until you can get his fiance visa form approved. Sorry but he should not go back to Cuba, he is likely to get stuck there. Whatever he does, he cannot come to the USA before he gets his visa. If he were to get picked up, or not show an entry date in the system, ICE will not allow him to stay even if you two get married. I know a couple that is married where he can't stay in the USA for just that reason.

Honestly he should not return to Cuba , if he does it, then looses the chance of being with you sooner , then you would have to file the form and wait for the waiting period for a fiance , which I do not know how much it takes. ( on the bright side the fiance or spouse has the first priority and as per the USCIS website they are processing those Visas filed in April/May this year which is really good but I do not know how trustful is that information)
Once in Mexico as a cuban he can present himself at the border and claim assilum and there is a law that protects the cubans and allow them to stay here in the US. As a cuban he does not neccesarily need a visa from US to enter being already in Mexico
Cubans are allowed to migrate to the US by doing the claiming process it is just that there is a waiting period. If you marry him it takes less time and the fact he will be the father of your child helps even more.
By the way there are trips or flights from Cuba to US and viceversa( Charter flights hired by American Airlines) , they fly from Miami , but there are other countries like Mexico , Bahamas , grand Cayman , etc that can be used. Once the person is approved by the US government to enter into the US, the Cuban government usually lets the person leave , its just a tedious process but is doable. My friend's wife is coming that way on July 3rd in a Charter flight from Havana City to Miami. Need more info , send me an email tru this program and I may be able to help you. Good Luck!

He should not return to Cuba at all because it will delay his exit from there. It could be months or years. You should not wait to get married. You should do it now before doing anything else. If you are in love, why wait? Marry him now and then claim him as your husband and the father of your child. This will expedite things. If he returns to Cuba and the gov knows he is leaving they will probably not allow him to work or go to school. I believe in some cases the local police will try to find any excuse to harrass him before he leaves. It's not worth it because he might decide to escape by sea which is dangerous. Some Cubans have been known to also cross the boarder from MX but it's dangerous. The thing is that if a Cuban arrives in the USA illegally he can stay. Not like other illegal aliens who are sent back. But he needs to be in US soil to claim assylum. Go to MX and marry your man. Get the ball rolling before you have the baby and have to raise it w/o a Father. There are many separated families between Cuba and the US already.

Your problem is not easy to solve!And it is very similar to mine!Im italian I'm 27 and I'm with a cuban girl!The cubans to live out from cuba need a document called PRE.is the permission to live abroud, cuban authorithy give this doc. only when a cuban is marryed with a person of another country without this doc. he will have always problem to leave cuba!Two months ago after two year I took the decision to marry me with her and this is the best solution if you are ready to do it if you want to stay calm!He will have the documents to live in the Usa becouse he is marryed with you and can go out from cuba when he want why he have the PRE!Good luck!
