It all depends on if his name is on the child's birth certificate. If he is listed as the father and has been paying child support he can contact child services and tell them he wants his child. They will look into his background and if he comes up clean they will release the child to him.

Probably have to prove he's a viable placement for the kid, jump thru a lot of hoops and defend spurious accusations an/or outright vicious lies.Maybe take some parenting classes, whatever they say.
Your boyfriend is well-advised to TAKE ACTION NOW! to try to stop this from going forward. IF IT GOES ON LONG-HE MAY LOSE HIS PARENTAL RIGHTS ALTOGHTHER!
You might need to consider a temp guardianship w/some trusted family member.
His proper response could be very critical! It happened to me, now my child has a new family, a new last name.

He definitely needs to talk to an attorney. Child services does not remove children from the home of a parent unless there have been serious problems. Where has he been? Has he been paying support? Is he aware of anything that could have caused this action? He doesn't sound very involved with his daughter to me.

If he can prove that he is the biological father, he would be able to have custody over that kid if they feel like he is fit to be a parent. He will need testimonials from friends that will help convince the Child Services officer that he is fit to have custody.

He has the right to call an attorney and go to court to get her back if he is qualified. He can try calling child protection services, but odds are he is ultimately going to need to get an attorney anyway. Good luck!

request that the child be released to you. My sisters son went to foster care it took me about a month to get him home with me. you have to go through an interview a home study and background checks to make sure the home is safe

I would think that he could get her, the state prefers the kids to be with family anyway. I would have him call and find out more information.

He should contact the CPS office and tell them that if his child is in care that he will take her home with him. Usually thats all it takes - he should take his ID and her birth certificate with him.
