I divorced my husband a year ago when he stole all my belongs, ran off to AZ, moved in with another woman, and completley cut off all comminication with me. ....that is until he found himself in jail for failure to pay child support!! Then the love letters and phone calls started pouring in. This last year had been such a painful year due to the abandoment/ betrayal issues that I haunted me after he walked out. Plus I was still in love with him so when he finally started communicating with me and telling me how much he'd missed & loved me. I was happy. To make a long story short, he begged me out of $2000 for a non-refundable bail (he forgot to mention that) so he could come home to be with the woman he truly loved. Promising everything possible to make up for the hurt he'd caused. U guessed it..as soon as he bailed out..he dropped communication with me and moved in with the same woman he was initally with! He told me he'd pay the $ back...yeah right??! Can I sue him to get $ back?

Only if you can prove that it was a loan. You can sue him in Small Claims Court, however, you must meet the burden of proof by the preponderence of the evidence...do you have any witnesess that indicate the bail was amount was a loan? If not, you will not only not win, but be out the filing fee.

Non legal advice...fool me once, shame on you...fool me twice...shame on me. I hope that you have learned no matter what your prior history is with this man, he is obviously not trustworthy as having the best interest in yours or your children's future.

I imagine you could take him to small claims court, and you probably have hard evidence proving that you paid his bail, so it shouldn't be a really big deal to the judge, though the judge would question why on earth you decided to bail him out of jail to begin with.

But I think it might be worth it to sue him, though the chances of you actually getting anything are pretty slim. Courts are hard-pressed to enforce civil judgments. Good luck, though.

What do you have that will prove to the court that the $2,000 was a loan and not a gift. Your signature on the bail bond agreement does not provide the level of proof required to allow the court to return your money.

Yes.. you can and you don't need a lawyer. You must of signed the bail note and got a receipt. If you just sent the money and somebody else did the signing you may be out of luck..

You can take him to small claims court and a judge might take pity on you and not rule that you gave it as a gift in belief that you would have your husband back.

What your husband did is morally reprehensible. I am sorry for your loss and hope things become better for you this year.

You should contact Judge Judy and see if you can get on the show.

It sounds like you have a pretty solid claim against your ex-husband, and if they accept your case, you will get a free trip to Los Angeles!

taking him to court is no way to win him back. try some sweet talk and learn new recipes. the way to a mans hart is his tummy.
