I was hurt on my job as a garbage man during a severe snow storm. I ruptured tendons in my right elbow and forearm. Surgery made it worse. I was out of work for 1 year and 9 months. I was only paid workers comp for 1 year. I asked, written, pleaded and begged for another posistion but was denied. A social worke for the NY state workers comp. board also called my job on my behalf and was told the have nothing for me! I filed for my article 15 ny state disability retirement an also went back to my job after a termination letter was sent to my address. I kept re- injuring my arm and used my sick and vacation time that i had remaining. I was a sanitation worker at the same place for 17 years. Mant times over the years they let the drunks and drug addicts tranfer to other posistions but they did not let me! I was sent by state retirement system to their doctor who stated I was permanently disabled! at wc hear. the jud. awrd me 21% loss of arm. $4500 disablity pension is only 33% of salary

You are now getting a disability pension. You will get this until you reach retirement age. Then you go over to Social Security and medicare. Workers Compensation is temporary. Your disability pension should last until you reach retirement age, in some states you will get this pension in addition to Social Security.

You need RETRAINING. Or work under the table. 4500 dollars a month is a good salary!!!

Sure, you can collect both. The problem is, you will either not report the incomes granted to each of the organizations and be found guilty of fraud which carries with it a jail term and fines, or IF you are eligible for both, each award will be reduced by the amount you receive from the other.

I think you can only collect one or the other, not both. I'm pretty sure the Workman's Comp. is only for temporary injuries anyway.
Are you eligible for any Social Security benefits? Any Job Training benefits available?
