the tenant vacated their apartment, and a day later my roof was leakin, i had an estimat for 4,000 in damages. the upstairs condo owner left a note to contact her and she had a couple different estimators come in all around the same 4,000 price range, after that, i was no longer able to contact her. when i finally contacted her, she stated she would have helped but she thought i was being ''greedy''. mind you, there is mold growing on my walls and ceiling at this point. anyways, she says i need to take the tenant to court. i just find it strange that she was willing to take care of it until she found out how much it was really going to cost. i just need to know which i am supposed to take to court, i just thought i am supposed to take the owner, and then the owner is supposed to take the tenant. and advice? im in Oklahoma

The owner is responsible for the unit they own. She should be the one paying for the damages caused to your unit, then taking her former tenant to court to recover her money. You can ask your HOA to help your case too. Mold on and in your walls can be deadly and will affect all the other condos around you very soon if it hasn't already.

take both because they will probley be on the same side against you and thats not good so i would take both because the owner is the owner of the building all you do is pay your rent like your suposed to and the tenant was stupid and left that running for no reason at all also what i would do if i was you i would move to a different place because once the owner finds out your making her go to court she will probley tell you to leave just because she will be mad and knows it will cost her because she knows that you are right and plus she should keep the building up to code and any ways a house is cheaper then rent now a days and you will eventually own it to but yeah i would take both to court

Your easiest route is to let your homeowner's insurance handle the problem, and let THEM take the upstairs owner to court, which they WILL do to reclaim damage against her, or her insurer.

You DO have insurance on these premises don't you ?

You sue the owner. She has to go after her tenants herself.

Both, whoever has the deeper pockets usually ends up paying.
