Can someone call the police on my girlfriend for smoking marijuana and have her take a drug test to proove that she uses marijuana?

Now If a police office caught her in the act I suppose they would either arrest her or issue her a citation for drug abuse. My question is do they have the right to invade her privacy and make her take an on the spot drug test or would that be in invasion of privacy?

No she is a mother in good standing and is under no investigation what so ever. She has no criminal record. But her room mate is thretening to call DCF on her and have her child taken away because she does smoke pot once or twice a month.

yes what happens is she calls and child services and they are forced to investigate allegations of child abuse or neglect and using drugs is considered that. So they can make her take a test, or she can call the police while she is smoking when they respond they will smell it and arrest her for illegal drug use and take the child best not to use ever ever ever

On a call , I doubt the Police would come out anyway. If they saw her do it , then yes, she could be arrested. You said "a mother" meaning she has children. Police can forward that call to Children's Protective Service and they can , and will come out, and yes she will take a drug test, then and there. If she is found to be doing this, they could take her children, right then and there.

If your girlfriend already has a child then DCF would probably get involved and take the child away. If DCF does get involved then it is possible for her to have to take random drug tests.

Yes. This can happen, and frequently does happen. The department of human resources/services will investigate the allegation.

They would probably have to catch her. They just can't go in like gang busters and have her take a DT. One could, however, turn her into the Social Services, hire a lawyer and have her proved to be unfit.

Now tell us if she's on probation. If so, yes. If not, no. There's no legally admissible "on the spot test." But m/j stays in your system long enough to do an admissible test.
