someone please explain this to me is it agemnst the law for a 26 year old to have sex with a 16 year old

(A) No person who eighteen years of age or older shall engage in sexual conduct with another, who is not spouse of the offender, when the offender knows the other person is thirteen years of age or older but less than sixteen years of age, or the offender is reckless in that regard.
(B) Whoever violates this section is guilty of unlawful sexual conduct with a minor.

(4) of this section, unlawful sexual conduct with a minor is a felony of the fourth degree.

(2) Except as otherwise provided in division (B)(4) of this section, if the offender is less than four years older than the other person, unlawful sexual conduct with a minor is a misdemeanor of the first degree.

(3) Except as otherwise provided in division (B)(4) of this section, if the offender is ten or more years older than the other person, unlawful sexual conduct with a minor is a felony of the third degree

The only way it is legal is when the 16 year old is the legal spouse of the 26 year old.

Any situations outside of a legal marriage is unlawful sex with a minor.

Yes it's against the law! Yes, there is the age of consent rule but there is also a limit. In some states, a 17-year-old CAN have sex legally with a 19-year-old. In other states, the margin is three years max. Why a 26-year-old is desperate enough to want sex with a 16-year-old is beyond me.

I'm 26 and there is no way in hell you'd ever catch me interested in a teenage boy. Hell, you likely won't catch me interested in someone more than two years younger than me.

I assume you read my first answer. The first part in (A) says that no one over 18 can have sex with someone under 16 (not 16 years OR under), unless they are married.

So, with the way that is worded, someone who is 26 could have sex with someone 16 as long as it was consentual.

I wouldn't though, just because 10 years is a large gap for this stage in life. 36 to 26 would be much more acceptable in social terms.

Technically yes, but most states will require a complaint from the 16 year old, so it's somewhat up to minor whether.

Sounds like it is legal for you to have sex with her at age 16.
