If you are inquiring about whether or not you will violate a patent, you most probably will. While the changes you make to the product, if not currently patented, would belong to you under a patent claim, any portion of the pre-existing product covered under the other person's patent would still belong to them under THEIR patent.

You provide too little information. Any product can be improved. If you take someone else's product and improve it, it does not make it your product. The product may be protected by one or more patents, and the changes you make may result in a product still protected by the patents, in which case you cannot claim the product as your own.
