What i mean is I have found another job paying more . And i gave my employer a week notice that i was leaving . When the final 24 hours came around i asked if they had my check and they said we dont have to give it to you for another week . Now by law do they have to give me my check then and there or with in the 24 hours of my final day ??? I know all about the 2 week rule and everything but im talking about what i just asked so ... please help me out , im in a bind !!! Thanks much

No, they don't have to give it to you until your scheduled payday...

it would be nice if the world worked that way though... :)

The state has the exclusive authority to make laws concerning when an employee gets her final paycheck, so you will have to look up what your state laws say in terms of an exact date. However, most states require that you be paid very close to your termination date. Many, like California, say that an employer is required to give their employee her final paycheck on the day she has been terminated.

Call your state labor office to find out what the laws are in your state.

Employers run their payroll on a normal schedule, usually weekly or bi-weekly. Unless previous arrangements are made your final paycheck will be sent to you when you should normally receive it. The reason they won't give it to you early is incase you decide to call in sick that last day or worse not show up. Then they paid you for a day you weren't there. So in your case your employer is correct and you must wait another week to receive it.

The Labor Code in California sets forth the guidelines, but if I remember correctly, they are only required to have your check "ready" if they terminate you. If you quit, then I believe they have one week from your last date of work in which to provide you with your check - or the next normal payday, whichever is first. They are not, however, required to have it to you within 24 hours if you quit voluntarily.

It depends on where you live - state laws vary. You should most likely get your check no later than your normal payday would be for that check.

They don't have to give it to you outside of their normal payday schedule, unless that schedule is longer than your state statute allows.
