i live in a duplex next door to my landlordthey just bought it 3 months ago and they are trying to annoy us enough to move out. im a month to month tenant with no lease agreement, they have threatned us into mowing the lawn and cleaning walkways and shoveling. They said if we didnt then the would require a yearly lease or evict us. They have just raised the rent because i didnt mow fast enough for them, and they are now asking us to give 60 days notice instead of the standard 30. Im a married man with 2 kids and a dog, whats happens if the evict us? what should i do? who should i contact for more information? im from new york and this is making me mad to have to go through this harrasment.

You should have had a lease.

Absent any written lease, the landlord defaults to state or local statute for conditions of the rental agreement. He can probably end your tenancy with 30 days notice. If you have no lease indicating 60 days notice, he must default to the statute. Rent increases are also governed by statute, and generally they can be increased with 30 days notice.

You need to check the landlord tenant laws for the state/area in which you live. Sad to say, I think you will find them fairly lenient to the landlord.

Perhaps this landlord is only bringing rents and requirements for you up to local standards for renting ? In my duplexes, tenants are ALWAYS responsible for lawn care, shoveling, and so on. If your rents were below market, he may as well be bringing them into proper perspective.

If you are being mistreated by your landlord the best thing for you to do is to find you another place to live. You could go to a higher authority such as HUD but any action they bring upon him he will take it out on you. Unless you are on the go that is unstable you should want a lease for six months or even one year. That protects you from your landlord raising your rent from month to month. with 6 months or 1 year lease you know your rent will be that until a month prior to renewing your lease. If you are evicted you will have to find you another place to move before eviction. Since you have a family an eviction will go against you finding another place to live. Good luck.

just move! If i were you, I would stop paying rent and live there rent free until they formally evict you. They would have to get a court ordered eviction to kick you out formally. I would stay there and turn the tables of harassment on them. for all the times they bothered u they couldve just been nice and given u a lease. so stay rent free for 3 months, save some money, find a new place and be done with these fools.

all the LL needs to do is file a 'no cause' for 30days and you are out.
if the agreement states; you should do the lawn on your side and maintain the side you rent anyway unless they have a maintenance plan for the bldg.
