My brother and his wife are biggest screw ups u can come across and have really made a mess of their marriage, unfortunately, their lovely gorgeouse 3yr old boy, my only nephew is being affected, she wont let any of us see him. Nobody connected to my brother. And its really breaking my heart, i havent seen him for months. They have a court order against us, yes they've bribed the judge and got it ( i know this for a fact). Theres not much we can do, is there anything legal i can do to be able to see him.

No you cannot. It is their marriage their child. They are not physically abusing your nephew. Yes the child does see arguments, but by your visiting him will not take away the conflict that he sees with his parents.

If they got a court order against you visiting, it had to be for a good reason. How did they bribe the judge, they gave him 50,000 dollars. Come on, if you have proof that they bribed him then take the judge to court with our proof. Who are you kidding?

If you want to be a good aunt, mind your business. Get your owns life. So you won't be so consumed by your brothers.

Time and time again courts (all the way up to the Supreme Court level) have upheld the wishes of parents who don't want the grandparents to see their children, so aunts and uncles would have have even less standing. As long as the child is developing properly and not being abused or neglected, the courts have held that parents have the right to raise them how they wish, and allow them to see or not see whomever they want. You are certainly free to pursue the matter with an an attorney through the courts, but know that it would be at considerable expense with not much hope - unless you can conclusively prove abuse and/or neglect.

I hate to sound so negative, it's just that I work in a law firm where we do lots of family law, so I've seen and heard it all.

Well ...
1.If the parent(s) are unfit and you can get REAL proof..
Like leaving kids with someone underage.
Drug or Alcohol use in the home.
Hitting or abusing children.
There is legal action you can take , in the best intrest of the child.
2. The father.. has visitation rights, if he is paying child support. Arrange with your brother to see this child on his visiting times.
3.Send this woman a letter telling her that you dont care what happened between your brother and her , and you really miss your nephew and would be willing to help out or babysit if she needs help. - (You might not like where it is she is going... for exapmle .. she may abuse that help and use it for going out to bars ... but any time ... even if shes spreading herself around.... spent with him is a blessing) and believe me... When poor women.. who still act like children... want to go out... they sooner or later leave thier kids with someone... in thier minds they have better things to do.
That also lets you in to door to see any neglect... including alwasys leaving her child with someone.... She just knows by keeping the child away that is what hurts your brother... so she right now is doing everything in her power to make him misrable... Just wait it out...
They usually need help with childcare.. when you are single... its a must!

The legally correct answer is no, you do not have standing to see your brother's child.

The ONLY person in this scenario who has visitation rights is your brother and only through the court. So, did he file for visitation? And, if not, why not?

The only way for you or any other family member to have access to a child that is not yours is through your brother.

Unfortunately, only the parents can sue for visitation rights. If your bother has rights, he can let you visit the child.

I guess u can appeal and reverse the court order.

see a lawyer one who specializes in family court law and you may get it over turned and you will get to see him . I hope so for you and his sake . good luck and I will pray for you dear . god bless you .

Get a lawyer and fight. It will be very expensive.
