i HAVE JUST COMPLETED MY FORMS AFTER MY 1 YR ANNIV. AND YET A REHIRE JUST FILLED THEM OUT TOO....WHAT GIVES? IS THIS UP TO THE COMPANY?

Well, it is normally 1 year, but I recently returned to a company as a rehire and in my negotiations, I got them to give me my original seniority and my benefits from day 1. That person may have done the same. I doubt that a brand new hire could get something like this, but a rehire is in a different category. Hope this helps!

1 year is standard. Yes, it is up to the company as to when to start the clock on rehires.

There are Enrollment dates for 401K participation and like company sponsored health insurance, the rules for new hires may be different than with someone who has missed the signup date and needs to wait for the next one.

This is NOT a legal question but one to ask HR.
