When my wife and I were married, she used a last name that she took from her stepfather but she never had it legally changed. Can I get an annulment because of this?

She used this last name in her high school records but her step father never legally adoted her.

No this is no reason for annulment of marriage. She was not adopted by her step father what you mean by this? The very fact his step father her mother & she got her last name from him, so this wife of yours started using that last name for herself too even her high school records states her last name as of her step father & on the basis of this record she used this last name during marriage with you. The very fact her identity is not in question the question of annulment doesn't arise in such a case.

I assume that's not the reason you want the separation. Depending on the state you live in you could annunl your marriage because she married you under a false name. So yes, but you cannot get the annulment if you have any children together or you two have property that you need divided in court.

I can't imagine anyone wanting to annul a marriage over a technicality.

my father used an assumed name from his people who raised him and in new hampshire the marriage between him and m y mother was not legalafter 18 years of marriage, they had to get marie againand i changed my own name to be legal, all my brothers and sisters had to do the same .some did some didnt. if she assumed a name of an adoptive father it isnt legal it must be done legally changingher lastname. i also went thru having to do it with adopting my daughter. , you were not lawfully married to her and a court will agree with your petition and if you are in the UK i readthat as longas you can prove it you dont even needa divorce. makesure you have everything in wriing. if your wife wasnt adopted then sheis in the wrong

You could say she deceived you. Annulments are hard to get. You have to contact a lawyer and discuss if you can get it in your state and discuss divorce if you cant get an annulment.

so you want to base your anullment on the factor that you never married the right person because of a last name.

what name is she using on her social security card and on her license.

i dont know, you will need to talk to a legal aid.

Are you serious? You want to end your marriage because of her illegal last name? Did she use this name to commit crimes or something? Is she wanted by the FBI? Why would you wanna leave because of something so petty? Is there more to this story or what?
