to make a long story short I am selling my home rent to own. The man paid me a down payment of 2000 dollars along with the first month payment. I was going to make the contract out myself he wanted his attorney to do this. After months of waiting no contract so I made one in which he refused to sign although it was all we agreed to verbaly he later mailed me his version which was way off base. Refusing it I went to magistrate court to have him removed from home for not signig an agreement later I find not keeping grass cut no electricity in home or water. I went up to home to hand deliver a notice from city to cut over grown grass upon arrival found a mess with house the house was open I shut the windows and placed locked on basement (knocked off ) took pictures of the house being destroyed...do I have a right to bring these facts up in court along with original complaint or can I be in trouble for entering home to secure (did get court permission not in writting verbal) . thanks

well it sounds like you still don't have a lease option contract signed.

do you even have a lease agreement signed by this tenant? even if it's a month to month?

You need to hire an eviction service & get this jerk out of your home IMMEDIATELY!!!!!!!!!!!!

I personally do not like the Lease option. However with the right tenant it can make sense because of the option money you as the owner can charge. $2,000 sounds pretty cheap for option money. Even if you were selling your home for $100K, you should be asking for at least $5K.

This money would be yours to keep & non-refundable to the "buyer" should they choose NOT to option their right to buy.

Just rent out your home, do a month to month lease with your next tenant, if they're good tenants, NOT trashing the place , paying on time, all the time, then consider extending the lease to 3mos. or 6mos. or even 1yr. if you're happy w/ them.

as far as this guy goes GET HIM OUT OF YOUR HOUSE YESTERDAY EVICT EVICT EVICT!!!!!!!!!

***** if you do not even have a lease agreement signed with this tenant, you could just call the police & have him thrown out since technically he is TRESPASSING!

unfortunately you should not have provided the keys to the home until the contract was signed, the landlord always draws up the contract never the other way around, if the lessee doesn’t like the contract they can request changes be made to it but ultimately he either takes it or leaves it! Now you did not do this so there is no need to dwell on the "what where not done issues" . You need to proceed with eviction ASAP (legally) this may take more time than you care for but it must be handled legally to prevent suing etc. Now you maybe cautious if this person is malicious they may attempt to destroy the home further in anger, so take as many pictures as possible now so you have evidence if it is grows worse. You legally have the right to inspect your home when ever you like. Provided you give notice to the lessee. call your local magistrate to confirm exact requirements for entering the home (to confirm) all in all it will be a rough road for you and will more than likely take some time. In the end you should be able to sue for lost rent and any destruction damage to the home. Hang in there.

You should have had a contract written up before you even accepted this man's money or let him move in... without a contract you case could go either way in court. Next time make sure the person you are renting to signs a contract before they get the key to the front door.

If you went in the house, is ok because tecnichly you are the landlor , however if you lock this person aout or remove belongings then you are in trouble so depending on this facs is advisable to use teh pics or not.
Also I would recomend to use an egent or to take the class yourself for your own protection with the different laws.

You are in good shape you had no writen agreement that would keep you from doing anything with the property. He was not even renting since he refused ti sign your contract. Get his by his short and curleys, if you know what I mean.pp

take plenty of pictures and file for eviction and no HE DOES not GET A DIME BACK!!! CALL IT A LESSON THAT COST HIM $2,000 AND ONE THAT YOU LEARNED FROM=ALWAYS HAVE A AGREEMENTS SIGNED 1ST AND THEN THE MONEY-HOPEFULLY AT THE SAME TIME!!
