I think Cheney is the one who is running the show, and he's trying to throw up a smokescreen now that people are onto what he's been doing - running the show with no transparency, oversight, or accountability.

The Vice-President's office is held within the same catagory as the President's office which is of the executive branch.

Article II Section 1 of the U.S. Constitution states:

The executive power shall be vested in a President of the United States of America. He shall hold his office during the term of four years, and, together with the Vice President, chosen for the same term, be elected, as follows:

Article II Section 1 Paragraph 6 of the U.S. Constitution states:

In case of the removal of the President from office, or of his death, resignation, or inability to discharge the powers and duties of the said office, the same shall devolve on the Vice President, and the Congress may by law provide for the case of removal, death, resignation or inability, both of the President, and Vice President, declaring what officer shall then act as President, and such officer shall act accordingly, until the disability be removed, or a President shall be elected.

Article I Section 3 Paragraph 4 of the U.S. Constitution states:

The Vice President of the United States shall be President of the Senate, but shall have no vote, unless they be equally divided.

Note as to your question:
He may have been mentioned briefly in the Legislative Branch, but he is mainly serving in the Executive Branch, which means he is a member of the Executive Branch and he has the same powers as President if the President cannot perform his own duties.

Get it right. He did not say this.

To paraphrase the argument, he basically said that the office of the Vice President is unique. As the President of the Senate, his office straddles the Executive and the Legislative, since he serve a function in both branches.

It's still a pretty crappy argument on his part, but at least state it accurately.

He's way over the line, especially since as far as I can tell he's not saying he's part of the legislative branch which as President of the Senate he is a vague sort of way. He's not part of the judicial branch.

Everything in the Federal government is part of the Executive, Legislative or Judicial Branches. The VP's office doesn't get his own branch.

The lengths people will go to to excuse his behavior is startling. This is just typical Cheney trying to hide and cover up things. We should have expected something like this.

Actually, his claim is that he has a dual-role, and that his NON-Executive Branch requires certain sensitive materials NOT be released, nor is he in that role required to release them.

In this, he is correct.

No jobs have been moved around. No roles changed.

If I am a doctor and a plumber, and I am asked to reveal my records for a client that I have been both plumber and doctor to, it would be a violation of my responsibilities as a doctor, but not as a plumber.

Not too hard to understand.

his argument makes sense, but he should still release what they want. he is a servant of the people and should be held accountable.
