Should your parents be able to take their parents money after having the state declare them incompetent? This is what is typically done, from what I understand. In this way, the state pays the enormous costs of nursing care and their kids (your parents) get the your grandparents money. However, at this point, your grandparents would be stuck to live out the rest of their lives public (welfare) facility since they now have no money. Is this right?

Sophist: Not true. I am 45 years old and have gone through this with my sister who wanted us to jointly take my parents money and put them in a home. Not to manage the money, but to keep. for her "children's education". I refused. After 7 years spending every sent of their savings in a private nursing home, my sister finally agreed that I was right.

No they should not be able to do this in fact it is against the law and if you have proof that they are misusing your grandparents money or got it illegitimately you can turn them in

If the Grandparents are incompetent and unable to care for themselves then their children have the obligation to use the money to care for the Grandparents. Adult Foster Care, a Nursing Home or at home care if that is a possibility. Being mentally incaple is a fearsome thing, especially for the affected person. The family involved has very real burden in their care. People should not be thought of as disposable. I had to put my Husband in Adult Foster care. I found a wonderful place. The price is $30,000.00 a year. He is worth it. I took care of him for 8 years and just got too tired to do it any more. 24-7 is a killer. Yes the Parents should use the money for the Grandparents.

The greed is their problem. The state is unlikely to declare anyone incompetent for no reason. You may want to check the facts. Having someone declared incompetent is usually a very long drawn out legal affair. Anyone who gains financial control of fiscal responsibility can also be held accountable in the courts as well.

Sluffing this off to the tax payer is just greed. Greed makes anyone less than appealing. Greed disgusts me, but oh well, the grand parents raised the parents who merely seem the grand parents as a dollar sign. You reap what you sow -- at least sometimes this is true.

They are not taking the money, they are managing the money. With your grand parents declared incompetent, your parents have assumed your grandparent's debts as well the authority to spend their money. The court oversees all transactions.

It certainly does not seem right does it. Some kids don't really care about their parents anymore and just want the money that they feel is owed to them. I would never do that to my parents. Its their money and if it would allow them to live in a more comfortable, caring facility, thats what would happen to it.

No, your parents have power of attourney and that makes them financially responsible for the grandparents.
