This is a state-specific question. In my state child support is an award to the child, not the parent and a child has 1 year after turning 18 to sue for back due child support. I don't doubt the folks who said "no", but that is a "yes" in my state. No one gets a "thumbs-down" from me on this question. I know other states follow the parental rights doctrine, but my state does not. I expect a phone call to an attorney would tell you which is the case in your state. I am an attorney who has represented children.

Sure! In today's world you can sue just about anyone for anything. But watch out: If your attorney won't take your case on a contingent fee basis, he's telling you something....

Seriously, you cannot sue. You don't have standing. The child support was not owed to you. It was owed to one of your parents by the other parent.

You could try to come up with something else and try to sue, but your chances are not too good (IMO).

The child support is owed to the parent. The parent can sue to collect, or make the decision to do without.

I've heard one motivational speaker describe the huge change in her life and outlook when she decided to free her ex of his child support obligation. He thought he was "winning", but she was released from needing him, calling him, and taking his abuse and negativity.

I don't think so, there's too many loopholes your X's lawyer could exploit. I think it's your responsibility to get your child their money, and it'd be much easier for you to collect than them. if you are perhaps the dead beat parent then it is the kids money, and if the system deemed your X and child poor enough to need support, then you really need to pay. Either way, don't forget, you could collect interest too... Good luck
