okk well umm i was at this club and some guys started fighting with my friends so i got in to seperate them n stuff but as i tried to do that i got stabbed on my bicep got like 14 stitches inside to repair my muscle and 15 staples outside to close it....and well alot of ppl been telling me to sue the club because they suppose to search before entering before weapons to secure ur stay i was wondering do u guys think i should ?? or do i even have a case??

well no i wasent drunk im actually 20 n i really not into drinking n stuff the bills for my medical were actually paid by my insurance so im good with that...but thanks alot for ur answers i think i may seek to speak witha alwayer about it

Don't know if you have a case or not... but do believe you have a good reason to talk to a lawyer about it as you may have a case.

Well do they search for weapons at that club? You said they are supposed to? Some clubs are not required to depending on the weapons law in your area, some places allow you to carry certain kinds of weapons (knives are most common,) depending on their length and whether it is a switch blade or whatnot. So I would first call the local police department to report the incident, because the club may have not (which is also illegal I believe), and just ask the police officer if you are allowed to sue, he or she should know. I think you can, but at the same time, you CHOSE to get between the guy and your friend, and that might automatically cut out the club's liability.

If a Judge can sue the cleaners for losing his pants. Then you can sue too. He lost the case.
Years ago McDonald's were sued by this overweight obese lady because she frequented the place, and blamed McDonald's for her being obese. By the way she won the case.
It's a free country, the question is not if you can sue? The question is can you win. Who knows? Our judicial system is all screwed up. Ask an attorney. If he takes the case Pro-bono then most probably he feels you have a good case. If he doesnt then, forget about it.

Yes, tha's why they pay insurance and goverment license to operate. All comercial facilities are responsible for the safety of their clients and visitors (inside or in the parking area) even if they are no requierd to search for weapons.
Some rape victims or their families in the case of murder have sued malls and university under the same principle.
Just don't expect a million bucks, you will be mostly be paid in proportion to your damages, injuries and medical costs.
Forget about the "sufferins and emotional pain" (like that guys that was asking 54 millions for some pants the drycleaners lost) that's bogus and Judges hate that unless you are a rape,or torture victim. So concentrate on your madical bills, permanent injuries and damages.

I would seek an attorney. You can hold the club responsible. They have a duty to provide for the safety of their patrons.
You are 20, you may also have case in that they allowed you into the club and you are underage, unless of course it is an all age club.

Yes, you can sue the club. The incident happened on their premises and they should be responsible for your medical damages. They could also be found negligent for not properly checking for weapons which may endanger other club-goers. In fact, if I was the club owner, I would willingly offer to pay your medical bills so you do not sue me.

Yes, the club has a duty to provide a safe environment for its patrons. In most states you would have a case. Some states you will not recover for this so you should consult a local lawyer.

Doubt it...they have no obligation to search people....Ive been going to clubs for almost 30 yrs and have never been searched....you do have a case against the guy that stabbed you

you probably can, make sure to get a lawyer first. chances are if you have a case they will just settle. depending on how upscale the club is they wouldn't want bad publicity. you also have to make sure you have lot's of whitenesses

omg that's terrible, but i mean that kind of stuff happends in bars.
but its worth a shot, get a lawyer and see what they say about it because your situation is kind of like when a burgler is breaking into your house and they trip and break their leg or soemthing, they can sue you because they got hurt INSIDE your house.
im pretty sure if that burgler can sue, i have no doubts that you can sue if you got hurt inside that bar.
