First of all, a lot of "crazy lawsuits" are completely made up -- so much so that every lawsuit not accompanied by the names of the parties and a docket number I automatically presume to have been made up until proven otherwise. Except, of course, for that McDonalds lawsuit.

As to the McDonalds lawsuit being "crazy", however, consider the following facts:

1. The McD coffee at the time was being served at 20-30 degrees above the industry standard. The plaintiff's expert testified and the defendant's expert conceded that at that temperature, the coffee was undrinkable and highly likely to cause severe burns.

2. The woman in that case suffered 3rd-degree (full-thickness) burns, and had to be hospitalized and undergo multiple debridement treatments. If you don't know what "debridement" is, I suggest you look it up. I hope you have a strong stomach.

3. In the 10-year period preceding the accident, McD received over 700 WRITTEN complaints about people getting burned with their coffee.

4. The jury's verdict on punitive damages was equal to 1 day's worth of McD's national coffee sales. The judge reduced the final verdict substantially. Contrary to popular belief, the plaintiff's recovery was somewhere in the mid-6 figures.

5. Prior to trial, plaintiff gave McD a settlement demand of $20K. Based on my experience, this indicates that the case could have settled for about $15K, perhaps even as low as $12.5K. McD did not make an offer in that case. It made a decision to designate the case no-pay and to go to trial. This was a calculated risk on its part, and so it should stop whining. It got what it bargained for.

6. The biggest winners in the McD case were the consumers. After the lawsuit, McD recalibrated its equipment to conform to industry standards. Think about it: over 700 written complaints did nothing to persuade McD to make a change. One lawsuit did it.
