Parents are divorced, one parent arranges for young teen to babysit alone for periods of 5 huours or more, without other parent's consent. Teen has not been formally trained on CPR or anything. What if something happens? Are both parents liable?

Whomever is the custodial parent - unless equal custody was granted- would be responsible. If equal custody, equal responsibility.

The only way around this is to have something in writting - signed by both parents and a notary - stating that you do not take responsibility since you do not feel the 13 year old is qualified to babysit. If the other parent continues to allow the 13 year old to babysit, he/she take on all of the responsibility and you should be in the clear.

if the babysitting is not done in the parents home then they are not liable. If it is, you may be sued by the paenrts if there is an accident. But a non-custodial parent who's home is not invloved in the babysitting is fine.

The one who is liable is, the one that the child is living with and ok'd the babysitting. A child cant be in charge of another child!!

I wouldn't think so.... But you might want to get that 13 year old training. It's easy. And most of the time free. Our church does it. So you might want to check out some churches and see if they do.
