It's funny, because until very recently, Cheney said that he had executive privilege.

You can't have executive privilege if you aren't part of the executive branch.

Well, it's true that the office's only Constitutionally-defined responsibility is the legislative role as President of the Senate.

However, as a practical matter, the Vice President is generally assigned duties by the Chief Executive (the President), and takes part in the work of the administration, that is, the work of the Executive Branch. So it is difficult to make a case that the VP is not part of the Executive Branch, although it's possible that one could make a technical case for that position, relying on what the Constitution says (and doesn't say).

No. I don't. By definition, the Executive Branch includes the President, the Vice President, and 15 Cabinet-level executive departments. See Article II of the Constitution of the United States of America.

I was listening to a story on NPR this morning where they interviewed someone who said (paraphrasing):

"historians will laugh at Cheney's claims that the vice president is part of the legislative branch. It's simply untrue."

Cheney is just trying to find a loophole because he thinks he's above the law, like most of the Bush Administration. It's a total joke.

Cheney apparently believes his interpretation of the system of checks and balances is better than those envisioned by our Founding Fathers and by all of the past administrations, congresses and judiciary. If he worries that releasing his papers to the Archives is inappropriate in wartime, he could have them classified for security clearance as all prior administrations have done and placed into classified files. He seems to be exercising the kind of executive privilege that comes with a monarchy, instead of an elective office. Maybe they should change the name of the office from "Vice President" to "Autocrat"

He is a complete smart mouth, they should have shown him the door a long time ago. He thinks he is better than anyone even if we had a legal President , he feels he is above the law. That is one man that is crazier than Bush and that isn't saying much for him. Where does he get off that he is untouchable, I'd like to touch him with swift kick right in his big behind. He is most irritating man I have ever seen, I'll be so glad when he gets his sorry behind out the door, just think never to look at his smart mouth or face again, ever. That little quirk he does in between his lies.

No I don't agree with him. The office of Vice President IS part of the Executive Branch of government.

Cheney's statement is so stupid. Is he legislative or judicial?
I guess because he's prisident of the senate he's trying to sell the idea that he's legislative but the congress is elected by the various states and the districts therein.
He was elected on Bushes shirttails as part of the executive branch.
This is simply a stalling tactic. He knows better.

He is vice PRESIDENT, which includes president of the Senate. He is part of the executive, and ceremonially part of the legislative branches

If he is not part of the Executive branch, then there is a fourth branch of government at work. That is not called for in the Government charter so Cheney goes bye bye right now.
