Yes, If she has decided to carry the pregnancy to term rather than seeking an abortion(but then again, she could always change her mind at the last minute, many do. ), because he violates the rights of the mother by taking her life, and her rights to carry the child to term. If she has already made the decision to have the baby, then it is a potential life that he destroyed, exluding miscarriages or other problems that might not cause it to be born alive. Also, if she has decided to carry the child to term, she probably has already told her family, and they were expecting a grandchild or a nephew and would have already been looking forward to it. the murder of the mother would have a greater impact. A woman planning to have an abortion doesn't normally go around bragging about going in for an abortion. nor has she decided to carry the pregnancy to term. whether your are a pro-choicer, or a pro-lifer, murdering a prgenant woman seems to be far worse than just killing someone. That should be reflected in the laws and the sentencing carried out. I am not as much of a pro-lifer, as i am anti-criminalization. Criminalization makes anything impossible to be regulated, and promotes more problems by adding $$ to a criminal's pocket, which increased the power and resources of organized crime..

Because in this country the fetus is only a viable life if the mother says it's a viable life. In this case, the child (and it IS a child) was taken from her by a murderer. You asked an excellent question and undoubtedly you'll get the pro-abortion crowd screaming that the guy should only be charged with ONE murder. This argument actually surfaced during the murder of Lacy Peterson and her baby. There were pro-abortion groups that felt good ol' Scot should have only been charged with a single murder.
Why don't we wait and see what Dr. George Tiller has to say about the whole thing? I'm sure that he'll have an interesting take on this brutal crime.

Bobby Cutts is charged with 2 counts of murder because the fetus was viable in that IF the fetus had been born it would have been able to survive without aritificial help. If the fetus had been under 20 weeks where there would have been no chance of survival, he would have been charged with one count of murder. In this case, Jesse Davis's pregnancy was considered full term i.e. 37 weeks. This meant the fetus would have been able to breathe on it own without any help at all. In any event, the mother did not make the choice to have her life or her pregnancy ended in that manner, that was done by Bobby Cutts jr and according to the fetal homicide law in Ohio, any violence perpetrated by another on a pregnant woman which results in the death of the fetus at any stage during her pregnancy( but mostly recognized after the 20 week period) will be charged from anything from manslaughter to murder.

To those pro-choice people answering this question based solely on the women's right to choose........
-doesn't the baby inside of a women have the right to CHOOSE if it wants to die or not. Maybe abortion should only be legal if we allow the baby to get to the stage in life that he/she can decide for themselves if they want to commit suicide. That would solve this abortion problem the devil pushes as pro-choice b/s.
-It sounds like the only people that can make any decisions about a babies life are women. Did we forget about the man's choice (a baby has a mother AND father), the babies choice, and most of all, GOD's choice. God made the decision already. He even has a specific commandment concerning this issue.

Everyone knows a fetus is alive and human. The fact that it is living inside it's mother is enough for some to declare it is not worthy to live.

Actually the State of Ohio recognizes that the fetus is a person but the Supreme Court ruled that they didn't care what the states think.

Violation of the rights of the mother.
she chose to not end her pregnancy, and he did by murdering her.
no matter if you are prochoice or prolife, the murder of a pregnant woman seems to be worse than killing an individual. That should be reflected in the Justice system.

the real question, is why are you prolifers questioning it, almost defending the criminal, just to make jabs at prolifers?? sound hypocritical.

Because the RIGHT TO LIFE movement pushed for this legislation after Laci Peterson's murder. And that bill signed by Bush COULD BE a slippery slope to try and overturn Roe...so far they have not been successful in doing this, but it still remains a possibility. I always love it when people try to blame that legislation on pro choicers. BTW, even if you are pro choice (which I am) you would STILL think this was a murder, since it wasn't the woman's choice.

Glad jahpson thinks this stuff is so funny...creepy...

That would be late term. At the age in which the fetus was killed ( 9 months ) it has the ability to live outside the mother womb.
