before sex they both want it soo bad with eachother they start having sex and right before the guy is suppose to do his thing she says she doesn't want to do it anymore and for him to get off of her. but the guy is already in the "exploding" stage and can't control himself and does it and gets her pregnant. would that be considered rape and if so, would she say to the judge something like "i was raped i want an abortion" ?

by the not controling himself i mean the guy is passed the pre c.u.m stage. and he is like about to finish. and she says no right before he finishes. if that's possible.

not every state inthe US has abortion as legal. in less than 10 states in legal so it's not that easy without a judge.

If the woman says no at any stage and guy continues than it is rape.
It doesn't matter at what stage the woman says no, she has said no and that means that the guy should stop. If he continues and forces himself into the girl than it is a crime.

She can become pregnant even before he "explodes" as pre-ejaculate has sperm in it. If they started to have sex without using a condom and that was consensual, then she could have gotten pregnant then. There are two defenses in rape cases: "It wasn't me" and "It was consensual." In this case, the guy would argue that it was consensual to start. If it was illegal to get an abortion except in cases of rape, the judge would probably turn her down because she initially consented, even though she then refused. That's why it's important to have Plan B, it's important for the woman to be clear on what she wants, and it's important for abortion to be legal.

Yeah, anytime after the "no" it's rape. And he COULD have helped himself, you saying that he was at the point he couldn't control himself is absolutely wrong...
The judge has nothing to do with whether or not she'd want an abortion, there would be no reason to tell a judge that...
Not every rape ends up with an abortion (thank goodness!)

I am pretty sure that it wouldn't. His lawyer would argue that when the act started they were both consenting and it wasn't until they were nearly finished that she finally said no. I don't feel this counts as rape, most as regret. As for telling the judge that she wants an abortion, it doesn't matter what the judge says, if she wants one she can go get one...she shouldn't need to use rape as an excuse.

I dont think that is considered rape. She consented to it and during sex she thought against her actions and decided it was wrong. She shouldn't have done it in the first place. just because she said no just as he was at the "exploding stage' doesn't really make it 'rape'. I think if she got pregnant then it was her own fault and she is using the fact that she said no after it was too late is just an excuse.

it would depend on the amount of time was between stop get off of me and when he finished. if it was just a few seconds then no it wasn't rape. but if there was enough time for him to register what she said then yes it would be.i would think that if he could have repeated what she said then that is long enough. now using that as an excuse to get an abortion is messed up. seeing as there is a 18% chance that you can get pregnant from the pull out method there is really no way of knowing if she would have gotten pregnant anyway from the precum. she should have demanded that he use a condom from the start.

Sexual intercourse is defined as the penis entering the vagina. At the point you're talking about, that has already happened.

Rape can occur if the male does not ejaculate, so that doesn't even matter.

I'm not sure if it would be considered rape if the female initially consented, but then changed her mind and asked the male to stop. That would be up to a court to decide. The female's credibility would be seriously damaged because she consented to the intercourse in the first place.

are you for real so as the guy is cumming you say no he is then raping you and now looking agt 5 to 10 years in prison grow up, how old are you , and is this in any way you trying to shift the " blame or responsibility" off of your self i wish they would come up with a law that if the woman lies about rape she then faces the same amount of time the man was facing on the false rape charge

Is that kind of like the guy has an orgasm and wants to quit but the girl hasn't finished yet so she says keep going, and he screams rape??? Would you have considered it rape if you didn't get pregnant?

I'm no expert or anything, but I thought at any time a women or man tells the other to stop and they don't it's rape. BUT, on the other hand, if she tells him to stop at the very end......that's questionable. In that situation I wouldn't say it was rape. The guy may have not heard her if he was into it that much.
