Its your car! The impound lot should never have turned it over to him without him showing proof of ownership. What he is doing amounts to auto theft. Contact the police and explain it to them and show them your pink slip or proof of ownership. They will sort it out and probably send out a patrolman to assist you in recovering it. Big questions: Why was it impounded and for how long?

A police officer can search anybody as long as they either have consent or probable cause. Or, if the officer believes the person being searched might be armed, they can perform what is called a Terry Frisk. Not knowing the specifics of the situation, I could not tell you if the officer had any reason to believe the 6 year old may have been concelaing a weapon, or if the officer had PC, or if the man gave consent to have his son searched. And even though you may have full custody, the father had him in his car, under his supervision, and, assumedly, with your permission and knowlege. The officer was not obligated to call you first. My suggestions, if you want to pursue this, are to call the police station and ask to speak with the officer's supervisor. Although the officer may not have violated any laws, court decisions, or your civil rights, he might have violated the policies of his department. You can also consult a civil rights attorney. Most importantly, you may wish to reconsider allowing your son't father to take him out. My hunch is that your husband has a past history that made the officer nervous. LEO's don't normally go from a simple stop over a cracked windshield to searching the occupants unless there is something else to the story. If the officer overstepped the boundaries of his authority, then by all means, it should be addressed. El Chistoso

This is a matter of stolen property. An automobile can count as a felony the last I heard. Call the police let them know what happened and have them help you to go get your car. The only way this guy could have got your car is if you left it in impound for a certain number of days then the police have a right to auction it to the highest bidder.

call police department.
complaint = car missing, possibly stolen.
location missing from -- impound
taken by -- ex - bf, without permission (you believe)
possible current location -- ??
call NOW. A truly nice guy would have delivered it to you if all he was doing was helping a friend. This guy wants something, and it's probably either sex or the relationship to resume. Either is unacceptable behavior.
do NOT go get it yourself. That is much too dangerous. ex-bf isn't thinking too straight. Let the police handle this.

Do not go and take it. Call the police first and have them deal with it. If you never OK'd the person to take it then it's theft. As long as you have proof that it is yours then the police will help you get it back.
