The correct action is to report the abuse to the SPCA.
If they investigate, & find abuse, they'll take it away.
After being checked & treated, these can be adopted.
But you'd be foolish to adopt it, if you lived next door.

Legally it is not ok. It is considered theft and in some places, that is a felony. The only thing you can do is report it to humane society, ASPCA, animal control, or whoever is responsible to investigate abuse.
OR, you could go talk to the owners and see if they would be willing to give the animal to you. You would be surprised how many people would rather just give the animal away than have to deal with caring for it.

It is okay to keep it. The only thing you have to do is offer the owners to buy it for some dollars of something, because even if they are not taking care of it, they might call the police and get you in trouble. Or you can also offer to keep their pet and that you won't ask them for anything else. But they will have to sign something that will guarantee you the right ownership. If you are not willing to do this, then just be sure to have proof that they weren't taking proper care of their pet, in case trouble arrives. If not, then you can keep it. Good luck!

Yes, I think it is if you know they are being neglected or abused. I think it's the only right thing to do. When I lived in an apartment years ago, one of my neighbors had a beautiful golden retriever that he abused. I was friends with the girl who lived in the apartment underneath him and she saw him throw the dog down the stairs one day and heard almost daily abuse. He used to just open the door and let the dog outside without watching him so one day, I put him in my car and drove him to a shelter that one of my friends owned. The dog is now living on a farm with 4 other dogs and acres and acres of land and people who love him.
Legally, it may not be right but I can't imagine losing a case like this with all the witnessed episodes of abuse against this dog and I was more concerned with getting the dog out of the situation it was in as quickly as possible.

I would try to gain ownership. But you want to make everything legal, since for some reason, people that don't take care of there pets become very possessive and mean when you try to take them.
It is as easy as writing up a letter stating the transfer of the ownership, both parties sign, and it's done.
If they are reluctant to do this report them to Animal Control and they will help you out.
Good luck!

I would call animal control again and assess the situation that way. Animals are property and if you just were to take the animal its illegal and it may lead to some arguments between neighbors. But it's great that you care for the animal and are willing to take a stand.

I think I would be discreet about it in case the original owner wants to make trouble but I would definitely keep it if I felt it needed rescuing. No one deserves to have an animal they aren't going to look after properly. If you do it you might want to take a lot of pictures of it when you get it just in case it would ever go to the authorities, you can prove what shape it was in when you rescued it.
