What are the chances that this can be thrown out or what legal issues may I be facing?

In the Commonwealth of Virginia, law enforcement has two years to take out charges on an incident. They took out the charges withing 9 days of the incident. What you face is that the warrant was never served on you. There is no limit in Virginia as to how long a warrant can sit in circulation, due to the fact that, until recently, in order for an agency to serve the warrant on you, they would have to physically possess the original warrant. (Recently, this has changed. Certain copies of the warrant are legal.)

Don't try to get a charge thrown out on a technicality on your own. Get an attorney.
