You are LEGALLY required to have a W-4 and an I-9 completed and signed - both of which are filed with the IRS.
On the I-9 - you need to copy two forms of ID or a single passport, from them. One must be a photo ID

At a minimum the employee needs to fill out an I-9 and W-4. Other forms are up to you.

Have them fill out a W-4 form so you know how much income tax to withhold.
You will fill out an I-9 form and keep it on file to show that they are legal to work in the US.
