Depends on what job you're talking about. Some jobs don't pay minimum wage if it's a job that gets tips because they figure you make up the difference with the tips or that it eventually averages out to be minimum wage. Fair? No. I know there are pizza delivery drivers who deliver and get paid nothing but what they make in tips. No delivery fee that they charge the customer for....nothing. Seems there's alot out there who want to skip out on paying even the minimum.

Unless you are a waitress, you are entitled to the minimum wage set by the state you live in. Waitress make a fraction of minimum wage, plus tips. http://www.dol.gov/ From the Department of Labor Website: "Workers who are covered by the FLSA are entitled to a minimum wage of not less than $5.15 an hour. Overtime pay at a rate of not less than one and one-half times their regular rate of pay is required after 40 hours of work in a workweek. Certain exemptions apply to specific types of businesses or specific types of work." So your employer is already breaking the law. Unfortunately, Illegal Aliens are not currently covered under this law, and have no legal recourse, because to complain, you have to provide proof of residence to them. Not saying you are, but when I was in college, I worked in food service, and watched illegals get the short end of the stick often, using this loophole. Hope it works out for you.

If you're an illegal immigrant, then he isn't bending the law but breaking it by hiring you. If you're a citizen of the country in which you're working, then it's illegal for him not to pay you at least minimum wage unless you are working on some type of commission or an intern program. Report him if this is the case to the Department of Labor.

You don't state what your age or profession are. In certain cases, an employer is not required by law to pay minimum wage. Workers under age 20, workers who earn tips, workers who at a company that does less than $500M in business or apprenticeships for high school are college credits, federal minimum wage does not apply.

not enough information about your job.If all the forms for work were filled out SS number with holding information and so on. If he's not paying min wage he will get caught by the Feds. So there's more to the job you have not told us.

In the u.s. he has to pay you the difference between what he paid you and the min. wage for the entire time that he underpaid you. Contact the Department of Labor. www.dol.gov

When is he bending the law? Um, NOW.
Either report it, or ask him about it. He may not know that he's doing it, or maybe he thought he just wouldn't get caught. When you mention it, or ask him about it, he should fix it immediately, but if he threatens to fire you, talk to someone to report him.
