Laws vary from state to state as to the statue of limitations for bringing a personal injury lawsuit, most being 1-4 years from the date of the accident, so it is most likely the statue of limitations has expired.

If you had medical bills from the auto accident this should have been pursued with the driver's insurance company after immedately after the accident. If you have done nothing to pursue anything until now you would not be able to win the case anyway because you have not met due diligence requirements.

If you need not seek medical treatment immediately following the accident, it would be harded to link your injuries/medical bills to the auto accident.

Forget it. The medical waiver part isn't important. It simply releases the EMTs from liability, not the drunk driver. However, your complaint is MIGHTY stale. No judge will ever hear your complaint by now.
