I got divorced and my ex is supposed to refinance the home and pay me $15,000.He can refinance but wants me to sign a quitclaim deed and a disclaimer deed without paying me. The house will go into foreclosure if he doesn't refinance because he is so far behind on the payments but he will not have enough left over to pay me.I need my name off the deed but I also need my $15,000.Will signing the papers void the divorce agreement?Will I still be able to get him to pay me?I can't afford a lawyer nor do I have time to see one.

DO NOT SIGN A QUIT CLAIM DEED!! If you sign you will never get your money. You do however need to consider the fact that if the property gets foreclosed you will not get your money either. How much would he get back from the refinance?? Decide if that amount is enough for you and if so go to the closing with him and have the title company hold the deed until they give you a check. Do not give it to him directly.

The divorce decree is like a guideline. Sign the quick claim deed because he's in a bad situation and cut the man some slack; think . . . .can you afford to take the credit hit if the house forecloses? Your credit will take years to re-establish after a foreclosure. You can make the 15,000.00 working at Exxon as a second job.

Yes, it will void the agreement in the divorce decree, because you will be signing a legal document, and one supercedes the other...
