hes just moved her upto scotland from a shitty exsistance in england.theyve just moved in together so if there is a commonlaw wife rule i dont think it applys yet.neither of them are willing to move out and the poor guy,this woman is mental..he needs good advice what can he do?its looking like she was just using him to get a house.please useful advice only

It depends on who took out the lease. If she took out the lease then it is 'her' house and he has permission to live in it. If he took out the lease and she was only nominated as living there then it is his house.
Since she has the kids she requires the assistance more than him and this is common practice here in Australia too for someone to 'get the foot in the public housing door'.
Legal advice for him would be the first thing he needs to do and take the lease with him so they know exactly what the conditions of tenancy are.
Having someone move out is difficult if they have co-signed the lease as it is their right to remain also.
If I was counselling this fella I would tell him to find out his legal rights first. Then ask him at what cost to his own happiness is this worth? And suggest after speaking to Solicitor and if they recommend it, he contact the Council to find out if they have something for him to move into. He must make sure she knows nothing of this as she may take 'revenge' and sell or trash his stuff.
Very messy and this isn't taking into account his emotional situation. He is lucky to have a friend such as yourself.

Well, here in the states it's called a States Attorney, it's like local law counseling for free. Look into something like that.
