My friend was married 7 yrs. wife quit working when they got married to "work on herself". No children. He owned house before they got married - refinanced a few years ago keeping the title the same. She claims fraud because he didn't put her name on the deed. She is getting $1200/mo. disability (1st time through) for borderline personality disorder that she just started getting right when they separated. She is also getting $1200/mo. from him - in addition she got $24,000 back pay from disability when they separated. Plus he had to pay for her new place--first, last and deposits - he has a crummy, inexperienced attorney. He's only a car salesman - the only thing he has is his house and his atty. seems to think she's entitled to around $75,000 of that (total value $300,000) - HELP - she's borderline psychotic and wasn't diagnosed that until right before they separated - she's violent, manipulative and unfortunately very brilliant (high IQ) and knows how to work the system.

I do not think she is entitled to the house because he owned it before they were married and twelve hundred a month from him sounds really over the top. I would egg him on into going to a different lawyer, Yes it would mean paying more right now but it could save him alot in the long run. Good luck.

It sounds like an understatement about her knowing how to work the system. Your friend should fire his lawyer and get a good one post haste. I am not sure about claiming fraud for who's name is on the house deed, that is not my specialty of law but she could very well get her portion of the house anyway. This is a classic example of the importance of a pre-nuptial agreement. If you own a 300k house then the agreement is worth having. Her mental state probably isn't going to be a help to him unless he was a victim of spousal abuse and has some evidence to back that up. It actually could work against him because if she is mentally ill then she could be un-employable. If she is not a certifiable danger to herself or others then it does him no real good.
Tell your friend to get as good a lawyer as he can or he is going to be taken to the cleaners. He may be anyway.

Be a real friend go and help him get a real attorney, one who will fight for him. He will need alot of support and watch his morale it will have high and lows.

You could also do some spying and watch his wife when she goes out and take pictures.

If all else fails make an anonymous call to the agency that rated her as disabled and tell them you know she is faking it.

Tell your friend to get a better attorney. She is entitled to the house because they were married. There may be a loop hole but only an attorney will be able to tell you that.

Your friend shouldn't have gotten married until he knew her better, right? A perfect example of why you don't rush into relationships. He obviously needs to get a better attorney.

He needs to get a better attorny fast and do something small in front of the judge that they wont notice to make her lose it and act like a ***.
