my partner died and left no will. a death grant payment was paid to my 3 and a half month old son. it was to be put into a trust fund that would give me access through a solicitor trustee. who will tell me what im allowed to do if i dont feel as if anyone is benefitting from the trust except the solicitors? what rights do i hold?

In your position as legal guardian you have the duty to ensure that your sons needs are seen to, this would include ensuring that he receives the funds set aside for him in trust.

You need to know the terms of the trust, the amount deposited into the trust and how you go about petitioning the trustee for disbursement of those funds. You'll need an accounting of the monthly or yearly cost of raising your son to determine what you'll need from the funds, usually 1/2 of the total expenses, to submit to the trustee. If you feel that you are not recieving the full amount available through the trust, you'll have to go before the court and request an accounting be demanded of the trustee.

You can only receive what the arrangement for the trust funds provide because the disbursements is covered by what were stipulated on as ordered by the court or laws prevailing in your locality. If there are violations, you can request for proper implementation or rescission in court.
