I'm on a lease agreement with 3 others. I want to hand over my tenancy to someone else for the room I have. What can I do to make sure the person taking over my part of the lease pays the rent/deposit through the end of the lease agreement (ends August 31st). Please let me know if I can just make my own written agreement with someone for my room considering it is OK with the landlord. Thanks!

If your landlord will allow a substitute tenant, you'll be off the hook.

If your landlord allows you to sublet your portion, the new room dog will have to pay you and you will then pay the landlord. The new roomie will be your tenant. If he doesn't pay, YOU will have to evict him through the courts, BUT you will still owe your landlord the rent that it due.

If you just move and let someone else move in without the approval of the landlord, you will remain responsible for the remainder of the rent. If the landlord has not approved the new occupant, he can have him evicted as a trespasser.

Everyone whose name is on the lease is liable for the full term of the lease. If everyone else skips off into the wind and the landlord gets ahold of you, you can be held responsible for the entire balance of the lease, not just your proportional share. You'd then have to locate the others and recover from them through whatever legal means available such as Small Claims Court.

You need to look at the terms of your current lease. It may or may not allow you to sub-let your tenancy. You are right to be concerned about the rent being paid, etc. because if the person you sub-let to doesn't pay, it can still come back on you.
