My new lease at my new apartment begins July 1, but my current landlord says my current lease expires 10am the day before. How do most people work out this situation?

Unless the time is explicitly specified, a lease starts at 12:01 AM local time (one minute after midnight) on the effective date. It expires at 11:59 PM (one minute before midnight) on the expiration date.

You should always allow for at least a short overlap when moving, for what should now be obvious reasons. It's not possible to move your stuff and clean the old place in the blink of an eye as you now have it scheduled. See if one or both of the landlords will budge a few days. Be prepared to pay for that, it's only fair all around.

If they can't or won't extend your leases, you'll have to do as another person suggested and move your stuff into storage for a few days and then stay in temp digs at least overnight.

That's against the law. If you have been making monthly payments and you have payed the final month in either the initial down payment of "first and last," or it has been deducted from your initial deposit then you are entitled to live there for the full month which as the gentleman above states end at 12:01 a.m. July 1st. Unless something different than month to month is stated in your lease or some other stipulation regarding your final month is in the lease in writing the landlord ha no legal footing to tell you different. Chances re he just wants to get you earlier to prep the apartment sooner to show it as quickly as possible (my landlord/manager gets a % of commicion from the apaprtments he rents, so naturally the sooner is the better for him as far as people leaving early). There are tenants rights commities in almost every major city. Look for yours and contact them for more information about your rights.

I would ask the new landlord if they can work with you and let you move in 2 or 3 days early. It may cost a few dollars but it is better than moving your items into storage, getting a hotel (or staying a friends) and then moving into the new place.

You may want to review your current lease, all of my past leases expired at midnight.

Talk to the leasing agent/landlord at the place where you will be moving to and ask if there is any way you can move in on the 30th, instead of the 1st. They usually have a degree of flexibility, because typically they "fix-up" the apartment between tenants.

Try talking to your landlord to allow you to stay the last night, and if they are just not cooperative, try staying at a friends house, and if that doesn't work then stay in a hotel that night. Sometimes that is just what has to be done.

Pack up and have the truck ready to go the day before, and spend the end date hanging out with a buddy or driving to the new location if its far, and spend the night in the alternative location, and in the morning drive the stuff to your new place.

Assuming that you are moving yourself.

explain your situation to your new landlord and ask if you could move in a day early, and then get your current landlord to give you till 12mid that day instead of 10 am

that doesnt make sense to me. are they trying to put you out before the other lease goes into effect?
