im concerned that the council may try to get house if my mother ever has to go into care and i am emigrating so would not be here to deal with it

Didnt see your last question but I guess the answer is how to avoid your mum having to sell her house to pay for care home?
she can sign over the house now to someone else. Better if they live with her (child/grandchild eg) as long as it is over 7 years until she is likely to go into care they shouldnt count as as deprivation of assets.
Another way is if she jointly owns the house with another person (husband usually) but could be another relative, is to own it as tenants in common rather than owners.
For both of these you would need further advice from a reputable solicitor, and they would have some legal implications which youd need to go in to. But they are options.

After the scandals involving Councils forcing people to sell their homes to finance their care there are a LOT of rules that apply ..

HOWEVER IF as you seem to be suggesting, the property will be empty and your mother has no prospect of ever returning to the house, BUT she still OWNS part of it, then I believe you could indeed find the Council trying to sniff out some cash ..

If you can find a relative live in it .. or pehaps get a long term Tenant ... the Council is not going to make some-one homeless (because they will have to house them) ...

If you have no use for the house & you sell up now the Council will have no problem getting their hands on your mums cash = in theory they can take it back even if your mum gifts it to you or others, although once you are outside UK they may simply give up :-)

If you have bought the house then its your house and not the councils anymore duh!!!

If your mum does go into care and you are away you can rent it out through an agent.

Put the house in a trust, then nobody can take it
