I always shop at ebay to buy stuff that I need. Most sellers I dealed with were pretty good. Even tho we don't communicate much, at least they would ship out my items asap. But this ebay seller, albertmacaw....lol I really want to call him ebay noob! He won't apologize when he delayed my shipment for nearly 3 weeks (and I still haven't receive it yet) . I've been sending him numbers of email since 6/4/2007, and he finally replied me on 6/20/2007. I even tried to be nice telling him where the problem is and suggesting where he needs to improve in order to keep his customers. But does he ever care? I cut and paste all the messages into 1 gif file so you guys can see how rude this seller is. (Polly = me, Bob = seller)

Tell me what you guys think of him. I would want to sue him for what he said at the very end. That's totally being racist! That's not against me only. He's against all the people who got non American last name

While I understand your situation and what he did was not right. You didn't write very nice things to him either. I think he was just saying something similiar to what you said to him first. I wouldn't go around telling people what to do... and maybe try and be more tactful in how you say things to people.
He does have freedom of speech... I don't think you can do anything about it.

Ålways pay for items by credit card through Paypal because then you have recourse. If you sent the item back, I hope that you did it in a way that it is traceable as the seller could say he never got it. As far as filing a police report, the seller has no grounds to do so. I would report the harassing behaviour and leave negative feedback on ebay. Also you can file a complaint about the seller and damaged product received through ebay as well. If the item was sent via the United States Postal Service, they have their own complaints process. They do not take kindly to people using them to scam others. Always document everything with ever transaction on ebay either as buyer or seller. If insurance is offered, always take it because it protects you if the mail looses it or they damage it.

Actually, the seller has 30 days to ship your item per FTC rules/regulations. He could have waited 29 days to ship it out if he wanted to.
If the seller wants to keep their Paypal protection, then they need to ship within 7 days from end of auction.

You didn't say very nice things to him either in your last email, by calling him names like "noob." That not only sounds childish, but you were provoking. The courts would see this as two children bickering and wonder why you're wasting money and time. Don't bother trying to sue him for slander.

In NZ you can report his kind of thing directly to the police. Maybe you can try this as racism is not to be tollerated and some police forces have an internet protection unit. Hope this helps, he sounds like a real piece of work!

Hi, I am a seller on eBay with a store. What this guy/girl did is uncalled for. If you paid for your item using paypal go to paypal and file a complaint. If you used other forms of payment you can go to eBay and file a complaint. You can also file a complaint regarding what he/she wrote to you.

sounds more like he is just disorganized. calling him a racist is character defamation, and he can sue you.
after reading your emails, i have come to the conclusion that if it where me, i would send your money back, give you negative feedback, and make sure you could never bid on one of my auctions again.
after the way you acted, what else would you expect??

K well it is defineitly a misdemeanor for being racist. I know for sure you can report it, but for the internet it is probably different. You should probably go to eBay authorities.
