It isn't illegal. If in your head shot you were; of a different race, a particular gender, you are shown worshiping(whatever your religion is), you were overweight, older, showing which is your sexual preference, basically anything that a person could dicriminate for. If because of any these things, you thin you didn't get the job or interview, than it would be illegal.
Sometimes employers are looking for a certain look that caters better to the clientel. Like if you were looking for a job at a fine dining restaurant and you had a lot of peircings and tattoos and maybe a mohawk, you probably wouldn't be a good fit for them. Interviewing takes a lot of time and time is money.

There are very few business that can legally request a picture with an application prior to meeting the person and restaurants are not one of them. Not even hooters make such a request. If they don't feel you fit they just don't hire you.

BTW - what restaurant is it - because if there is a certain established level of physical requirements - as in a Hooters, Wings, or Hawk's, then there is an obvious expectation of facial beauty and body style, due to the nature of the restaurant and uniform

It's pretty shaky. Could be a way to screen people that's not legal. For example, it's illegal to code applications for race - requiring a picture to be attached would do that.

Yes. As long as it is not used to identify race or creed.
They also require photos for driver licenses, passports, military ID cards, VA ID cards, many school ID cards, gaming licenses, professional licenses, etc. One of the biggest problems is identity theft and the photographs help prevent that.

i think its legal because if you interview a lot of people your going to forget who you talked to and what they looked like, would this place be like hooters..
