You have two choices. Stay faithful or tell him its over and leave.
Anything else is cheating and makes you a cheater. If you "don't want to feel like I'm cheating" then DON"T DO IT - don't cheat!

Don't cheat. And he is probably in jail because he did do it and because he got caught. Tell him that you don't want to wait for him and that it's over. But be ready for the consiquences of your actions if you cheat or dump him because he may come after you.
