now that we have someone moved in ( only 6 days) she has left a note on their door stating that we owe like 4 months rent and that the police will be removing the new woman adn her children in the morning.... what can we do....

the lease allows for sublet as long as landlord is notified.... we moved out a month ago. and agreed that the new tenants would start paying on the first of july and that we would make up for the june payment with tax return. we last spokewith landlord last friday to let her now the new tneants would be moving in on saturday... now this morning new tenant finda a note taped to front door stating police will escort them from the house in the morning... and claiming thatwe owe 4 months backrent... havecopies of checks to prove otherwise

For starters, if you moved due to relocating for a job, there are outs to a lease for such a reason.
... Do you have it in writing that she wanted you to sublet? If not, it will be her word against yours.
... Do you have either cancelled checks or receipts for the rent she is speaking of?
... Have you tried speaking directly with your landlord to find out what exactly she's talking about?

All of these are things that will either help or hender in proving your case. Communication is the key to everything, so I suggest making sure you have everything documented and all ducks in a row in the event you have to go to court on this.

Furthermore, some states have a renters association. In order to find out for sure, contact a real estate office and ask them, they would know for sure.

The landlord would need a court order to throw out a tenant and force you to pay 4 months rent. I think if this goes to court she will lose. Even if you left before your lease was up, she is required to make a good faith effort to rent the apartment, so it would be unlikely that a judge would make you pay the 4 months. Did your lease prohibit subletting? If it did, that could be a problem because you can't verbally change a written contract. She might be able to evict the new tenant, but not tomorrw. Good luck!

Did you move out before your lease was up? Did you leave owing rent? If not, it wasn't your responsibility to find another tenant for your landlord - sounds like she wanted you to do her job. Also, I doubt that she can have the new tenant put out in just a day.

Your landlord has put you in a very bad position, assuming that you do owe the back rent.

You could wind up being liable not only for the rent, but for damages to the person you sublet to.

You seriously need an attorney.

um well thats ridiculous. first of all if she wanted you to sublet u should have signed over ur lease upon her approval to the new tenant. if so she is the new tenant of record not you. therefore she cannot evict this new person. i think you need to call her and find out what the deal is. did u sign an agreement to terminate the lease? u need to talk to her and come to some sort of agreement.

you're responsible for the lease. did you lease the apartment for more than what you were contracted for? next time, have your subletee pay you directly and you pay the landlord.

I don't understand why you let a woman and her children to move in with you when you intend to move out of that place real soon.
