Burning poison oak or ivy will cause the poison liquid to permeate the smoke and spread. It is possible to inhale the smoke and get the poison in the lungs. Place it in a plastic bag and discard it in the trash.

NO !! DO NOT BURN THE PLANT !!, nor any other plant that has the first name, "poison", as told by most of the answerer's, this plant has toxic vapors. Wear gloves as recommended, but, toss those in the bag to go', then, "I would highly recommend, after you finish the deed, that you wash up thoroughly, and, clothing that may have came in contact with the NASTY plant needs to be washed ( I would even recommend a splash of vinegar with the wash,...you,won't smell it after the wash<----the vinegar!).As far as your burning question, your local fire department can answer that,on a daily or regular basis, if, it is allowed at all... sincerely, and Good Luck.

Why not pull a black hefty bag over it?
Don't use the flimsy kind, but the heavy duty contractor's variety that are practically tear proof. Pull the bag over the plant first, then dig it up. Once it's out of the ground, flip over the bag and the plant will drop inside.

From there, I'd tie it up and toss it out in the garbage.

if you burn it, the poison is then released into the air. when the oils in the air make contact with your skin or anyone for that matter, you get the poison even worse then had you touched a small piece of it. do not burn it. hire someone to remove it from your property.
