my ex is taking me to court he has sole physical custody by default. he wants madify the order so i will see less of my child with him. i have another child and they almost never see each other will the courts give me more cutody so the girls will not be seperated?

No, they wont. You made a mistake not getting a lawyer when he was going for custody. Or at least showed up. If you want more time, you will have to prove you have evolved as a parent. Then you will have your girls together more.

Seriously doubt the courts will give you more custody time but also doubt they will take any mor of your visitation away from you unless he has a real justifiable reason for doing so. Just explain to the Judge why you feel the sisters shoulnt spend less time apart and actually should spend more. Since hes taking you to court,hes paying the expenses so use it to your advantage as you have nothing to lose. Good luck

Nope if he got custody by default that means you didn't show up. If you wouldn't even show up, or fight for your child you don't have a snowballs chance in hell of getting it changed. Why wouldn't a mother fight for her child in the first place? I am a single dad who has custody of all my 3 kids. I have gone to court 3 times and paid thousands of dollars in lawyer fees for my babies. I travel across the country to go to court. I will sacrifice everything I have for my babies. Maybe you need to have this attitude to start with and it might show the judge you are worthy of it. There has to be a reason he got his child to start with. Stop doing what it was that allowed him to get her in the first place and maybe you can see more of her. I know this sounds harsh and most likely will piss you of. Too bad I deal with an ex wife who only sees the kids every 3 months and makes nothing but trouble for me and the kids. I cant understand any parent who wouldnt fight till the death for the kids.

He should have solid reasons for wanting to modify the order. Unless he can prove something negative, like neglect or abuse, the order should stand. You never know with the court system, though, so be prepared.
