HE RAN . AND NOW i FOUND HIM..IM IN MARYLAND..I WAS TOLD IF YOU NEVER FILED FOR CHILD SUPPORT. YOU CANT GET IT ..IS THIS TRUE...I WANT BACK PAY..he live in washington d.c.....what can i do ....thanks to him ..i cant really afford a lawyer.....

Under law the legal doctrine of "latches" would prevent you from bringing suit for child support at this late date. However, if the father ever promised to pay you and then didn't pay, you may be able to go after him as an ordinary debtor. This will work only if you made regular demands for payment at least every seven years. Speak to a lawyer in your area about this angle.

Although Steve was correct regarding Laches (a right that is not exercised is lost) he was incorrect regarding any such promise whether verbal or in writing.

Laches would still apply in such a case.

Also, the child has no legal standing to sue for support at any time unless as a matter of arrears and in the case that you were dead and the child was filing a judgement suit on behalf of the estate.

In your situation, you have a particular amount of time after the subject child turns 18 to file for support. The maximum time I have seen in statute is 4 years. Therefore, the issue is moot.

You should have filed when the child was still a child. There is no reason why you should try to seek child support now. Your son/daughter is grown and presumably out on his/her own.

Child support is not meant to benifit the parent, but the child. It is not a reward for putting up with your ex, or for raising your child. It is not something you deserve. In fact it's not about you at all.

Once a child has reached the age of 18 , only the child can sue for back child support. If you never filed for it, odds are even the child can't sue for anything.
